Terms of Service
These terms apply when you use Cabpin: the booking and tracking pages of taxi companies that use Cabpin (for example choice.cabpin.com), the cabpin.com website, the dispatch console, the Cabpin Driver app and the Cabpin API. Cabpin is operated by Ratelsoft Inc. (“Cabpin”, “we”, “us”). By using Cabpin you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Cabpin.
1. What Cabpin is
Cabpin is software that taxi companies use to take bookings, dispatch trips to their drivers and keep passengers informed. Cabpin is not a taxi company and does not provide transportation. Each trip is provided by the taxi company you book with and its driver, under that company's licences, rates and policies and the local rules that apply to them. The company named on the booking page is responsible for the ride, the driver, the vehicle, the fare, lost property and complaints about the service.
2. Passengers
- Booking. A booking is a request to the taxi company. It is confirmed when a driver accepts it, which your tracking page shows. The company may decline or cancel a booking, for example if no suitable car is available or the pickup is outside its service area.
- Accurate details. Give your real name, a phone number where the driver can reach you, and correct addresses. Be at the pickup when the driver arrives.
- Fares and payment. You pay the taxi company or its driver directly, at its rates. Cabpin does not take payments from passengers and does not set fares. Any fare shown before a trip is an estimate.
- Cancelling. You can cancel from your tracking page until the trip starts. The taxi company's own policy decides whether a fee applies.
- Your tracking link shows your trip and the car's location to anyone who has it. Share it only with people you trust.
- Emergencies. Cabpin is not an emergency service. In an emergency, call 911.
3. Drivers
- You can use Cabpin Driver only if a taxi company has added you as one of its drivers. Your work for that company, including pay, hours and your licence and insurance, is between you and the company.
- Keep your phone and sign-in to yourself. Tell your company straight away if your phone is lost.
- Drive safely. Follow traffic laws, including laws on handheld devices. Only handle offers and trip screens when it is safe and legal to do so; use a mount and pull over when you need to.
- Record the fare you actually charged. Fares and trip measurements are kept for the taxi company's records.
- Use passenger details only to carry out the trip, and not after it ends.
4. Taxi companies and their staff
- A taxi company's use of Cabpin is also covered by its agreement with us. If that agreement conflicts with these terms, the agreement wins.
- The company is responsible for the people it gives access to (dispatchers, admins and drivers), for removing access when someone leaves, and for the bookings, prices and information it enters.
- Staff accounts need two-step sign-in. Keep your password and authenticator to yourself. If you lose your authenticator, email support@cabpin.com and we will reset it after checking who you are.
- The company must have the right to collect and use the passenger and driver information it handles in Cabpin, and must use it only to run its service and as the law allows.
5. API and integrations
- A company admin can create API keys and connect other systems (its own software, a booking desk, or dispatch software such as iCabbi or TaxiCaller). The company is responsible for those systems and for what they do with the information Cabpin sends them.
- Keep API keys and webhook signing secrets on servers you control; never put them in a web page or app. Revoke a key straight away if it may have leaked.
- Stay within the published limits (currently 600 requests a minute per key) and follow the API documentation. We may slow or block traffic that harms the service.
- We may change the API. We will not make breaking changes to version 1 without notice to the companies using it, except where needed for security.
- Connections to other vendors' software depend on those vendors, who may change or withdraw their services. We are not responsible for them.
6. Acceptable use
Don't:
- make false or prank bookings, or book for someone without their agreement;
- harass, threaten or abuse drivers, passengers or staff;
- try to reach information you aren't allowed to see, or test our security without our written permission;
- overload, scrape, copy or reverse-engineer Cabpin, or get around its limits;
- use Cabpin for anything illegal.
We or the taxi company may block bookings or suspend access that breaks these terms.
7. Our rights
Cabpin, including its software, design and the Cabpin name and logo, belongs to Ratelsoft Inc. You may use it only as these terms allow. Taxi companies keep the rights to their own names, logos and information. If you send us suggestions, we may use them without obligation to you.
8. Availability and changes
We work to keep Cabpin running, but it may sometimes be unavailable, for example during maintenance or because of problems with networks, phones, GPS or our providers. Locations, arrival times and fare estimates are approximate. We may improve or change features over time.
9. Liability
Cabpin is provided “as is”. To the extent the law allows:
- we don't promise that Cabpin will be uninterrupted, error-free or fit for a particular purpose;
- we are not responsible for the transportation itself, including the conduct of drivers, passengers or taxi companies, delays, missed pickups, accidents, injuries or lost property;
- we are not liable for indirect, incidental or consequential losses, or for lost profits or data;
- for anything else, our total liability to you is limited to the greater of the amount you paid us for Cabpin in the 12 months before the claim, or CA$100.
Nothing in these terms limits rights you have under consumer protection laws that can't be waived, or our liability where the law doesn't allow it to be limited.
10. Ending use
You can stop using Cabpin at any time. Drivers can ask us to delete their account through our support page. We may suspend or end access if you break these terms or if needed to protect people or the service.
11. General
- These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario, unless your local consumer laws say otherwise.
- We may update these terms. We will post the new version here with a new date, and tell taxi companies and drivers about significant changes. Using Cabpin after a change means you accept it.
- If part of these terms can't be enforced, the rest still applies. Not enforcing a term is not a waiver of it.
